Crypto and Side Income in Australia

The ATO treats crypto as a capital gains asset, not a currency, and it collects transaction data straight from Australian exchanges. Side hustle income gets the same treatment: platforms now report your earnings directly to the tax office. This is the foundation guide for our Crypto & Alternative Income series.

The short version: the ATO knows about your crypto trades and your Uber earnings. Crypto-to-crypto swaps are taxable events. Side income has no under-the-radar threshold. This guide maps the full landscape, from how the ATO actually finds out, through to what happens once you're earning consistent money outside a regular job.

Quick answer

Crypto is property for Australian tax purposes, so almost every disposal, selling, swapping, spending or gifting, triggers a capital gains event. Side hustle income has no tax-free threshold of its own. Platforms and exchanges report your activity directly to the ATO, so the real risk isn't getting caught, it's not knowing what you were supposed to declare in the first place.

๐Ÿ” The ATO Knows More Than You Think

A lot of Australians assume crypto is anonymous, or that gig work is informal enough to slip through unnoticed. Neither is true, and the gap between what people assume and what the ATO actually receives is where most accidental non-compliance happens.

For crypto, the ATO runs a formal capital gains tax data-matching program that has been running in some form since the 2014-15 financial year, and the current protocol covers the 2023-24, 2024-25 and 2025-26 financial years. Australian crypto designated service providers, in practice, the exchanges, are required to hand over customer identity details and transaction records. The ATO expects to receive data covering somewhere between 700,000 and 1.2 million accounts in each of those years, matched against lodged tax returns, with at least 28 days given to explain any discrepancy before compliance action starts.

For gig and sharing economy income, the mechanism is different but the effect is the same. The Sharing Economy Reporting Regime (SERR) started from 1 July 2023 for ride-sourcing and short-term accommodation platforms, and expanded from 1 July 2024 to cover most other electronic distribution platforms. Uber, Airbnb and similar platforms now report your transaction data directly to the ATO, twice a year. If you earned it through a platform or traded it on an exchange, assume there's a record of it somewhere the ATO can see.

None of this means you're in trouble. Most discrepancies are honest mistakes, wrong cost bases, missed swaps, income declared in the wrong year. But it does mean "I'll deal with it if they ask" is a worse strategy than actually working out what you owe.

โš ๏ธ Three Crypto Misconceptions That Cost Australians Money

Three assumptions come up constantly, and all three are wrong in ways that cost people money at tax time.

"I only pay tax when I cash out to AUD." Wrong. Every crypto-to-crypto swap is a taxable disposal event, based on the AUD market value of what you gave up at the moment of the swap. Trading BTC for ETH is a sale of your BTC in the ATO's eyes, even though no Australian dollars changed hands.

"I didn't make money overall, so I don't owe anything." Also wrong. You can't simply net your gains against your losses across different assets without proper transaction records for each one, and losses can only offset capital gains, not your ordinary income like salary or side hustle earnings.

"Crypto is decentralised, so the ATO can't track it." The blockchain itself is public, and the exchange you actually bought and sold through almost certainly isn't anonymous. Combine that with a decade of exchange data-matching history and this assumption doesn't hold up.

๐Ÿช™ Crypto Tax in Australia: The Landscape

The ATO treats crypto as property, not currency. Disposal, selling, swapping, gifting or spending it, triggers a capital gains event, and your gain or loss is the difference between what you received and your cost base. As an individual, holding an asset for 12 months or more currently entitles you to a 50% discount on the taxable gain.

That discount is changing. Legislation passed in mid-2026 replaces the 50% CGT discount for individuals, trusts and partnerships from 1 July 2027, with cost base indexation (your cost base adjusted for inflation) and a 30% minimum tax on net capital gains. Transitional rules mean gains that accrued before 1 July 2027 are still assessed under the existing 50% discount, and the new rules apply going forward from there. It's a genuinely significant change for long-term holders, and worth checking current ATO guidance as the 2027 start date approaches rather than relying on the old rules by habit.

๐ŸŒ Staking, DeFi, NFTs and Swaps

Once you move past a simple buy-and-sell, the tax treatment gets more layered. Staking rewards are generally treated as ordinary income at their market value when you receive them, and then a second CGT event applies when you later sell or swap them. DeFi yields are often treated the same way, income on receipt, with providing liquidity also potentially triggering its own CGT event. A few scenarios sit outside the standard framework and are worth knowing about before you're in the middle of them.

Crypto held in an SMSF is legal, but the compliance bar is strict. The fund needs an explicit investment strategy that permits crypto, the assets have to be held in the fund's name and kept clearly separate from personal holdings, and the concessional super tax rates only apply if the fund stays fully compliant. Lost or scammed crypto may be claimable as a capital loss, though not as a deduction against your ordinary income, if you can prove you owned the asset and permanently lost access to it. The gig economy is not a grey area, even though it's often treated like one. The Sharing Economy Reporting Regime means platforms like Uber and Airbnb report your earnings directly to the ATO. The taxable threshold for side income is $0. Every dollar is assessable, though tax offsets and your other circumstances may mean you don't end up owing tax on small amounts.

A few platform-specific things worth knowing upfront: Uber and rideshare drivers must register for GST from their very first fare, regardless of turnover, because ride-sourcing is treated as taxi travel under GST law. That's different from the usual $75,000 registration threshold that applies to most other side hustles. Many people assume casual side activity is automatically a tax-free hobby. It isn't, and that assumption is one of the more expensive ones on this list.

The ATO weighs up around eight factors to decide: profit intention, regularity and repetition, how organised the activity is, whether it's run in a business-like manner, its scale, whether you've registered things like an ABN, and how much knowledge and effort you're putting into improving its profitability. No single factor is decisive on its own.

Critically, hobby income is not automatically tax-free. If the ATO reclassifies what you're doing as a business, all of the income becomes assessable retrospectively, potentially with penalties attached. The flip side is that genuine business classification lets you deduct legitimate expenses against that income, so getting the classification right can cut both ways. Once your side income is more than pocket money, a few practical thresholds start to matter. An ABN is free to get via the Australian Business Register and signals to clients and platforms that you're operating legitimately. Without one, clients paying you more than $75 in a single payment (excluding GST) are generally required to withhold 47% of it for the ATO, the top marginal rate plus the Medicare levy, so not having an ABN can get expensive fast once you're doing regular paid work for someone.
