The ATO has no special rulebook for artificial intelligence. There's no "AI income" category, no exemption for tools, no grey area created by the fact a machine helped produce the work. The tax rules that applied to freelancers, digital product sellers, and content creators years ago apply to AI-assisted versions of those same activities today.
A copywriter who writes a blog post manually and a copywriter who uses an AI tool to draft it faster are both providing a writing service, the ATO taxes the income from that service the same way in both cases.

The ATO's key indicators, drawn from Taxation Ruling TR 97/11, no single factor is decisive, the ATO looks at the whole picture:
- Repetition and regularity: you're consistently selling, creating, or delivering work, not just occasionally
- Profit intention: you genuinely intend to make money, not just cover costs or enjoy yourself
- Real prospect of profit: a realistic path to profitability, not just wishful thinking
- Business-like record-keeping: you keep invoices, track income and expenses, maybe have a separate bank account
- Commercial scale: your activity is large enough, or growing toward being large enough, to generate a profit
- Characteristic of the industry: you operate the way others in that field operate, pricing, contracts, marketing
One-off transactions generally don't constitute a business, selling a single AI-generated image pack to a friend is very different from running a consistent Etsy shop with regular sales.

If your activity crosses into business territory, you need an ABN (clients may withhold 47% of your payment if you don't provide one), all business income is assessable and goes on your tax return, you can claim deductions against that income including AI tool subscriptions, platform fees and equipment costs, and you may need to pay tax instalments through PAYG once income reaches a certain level.
If you're still in hobby territory it's simpler but not entirely tax-free, some hobby income can still be assessable, particularly if the ATO determines the activity has a commercial character even if you don't think of it that way. When in doubt, speak to a registered tax agent.

Selling AI-generated digital products. Stock images generated with tools like Midjourney or Adobe Firefly, ebook templates, design packs, or AI-composed music sold through Etsy, Creative Market or Adobe Stock all produce ordinary assessable income. Gross receipts from every sale are assessable regardless of platform, and the cost of the AI tool used to create those products is a deductible expense, provided the activity is a business.
Freelance services using AI tools. AI-assisted copywriting, design, video editing, coding or translation is ordinary income from providing a service. The fact AI did some of the work is irrelevant to the ATO, you're being paid for the outcome delivered to a client, and that payment is assessable income regardless of how much AI sped up the process. Building and selling GPTs, AI agents or chatbots. Slightly more nuanced, since the structure of the transaction matters. Selling a custom GPT or AI agent as a one-off means the sale proceeds are assessable income. Charging a subscription or recurring fee for access to an AI tool you built is ordinary income, assessable as received. Selling a business that happens to include AI tools or agents may trigger CGT considerations, since you're disposing of a business asset, the CGT discount may apply if held more than 12 months and the relevant conditions are met. Worth a tax agent's input if you're building and selling at any meaningful scale.
AI-powered content creation. YouTube channels, blogs and podcasts using AI for scripting, editing, voiceover or thumbnail generation are treated exactly like any other content creator operation. Ad revenue, sponsorships and affiliate commissions are all assessable income, and the AI tools used to produce that content are deductible expenses. - AI tool subscriptions (ChatGPT Plus, Midjourney, Claude Pro, ElevenLabs, Runway and similar tools): fully deductible if used exclusively for income-producing purposes. If used for both personal and business purposes, only the business-use portion is deductible, keep a note of how you use it to justify apportionment if asked.
- Internet costs: deductible to the extent used for the side hustle, apportion if shared between personal and business use, a reasonable, consistently-applied estimate is acceptable.
- Computer and device costs: deductible, items costing $300 or less can generally be deducted immediately, items over $300 are depreciated over their effective life unless eligible for an instant asset write-off, check the current threshold with a tax agent since it's periodically reviewed in each year's budget.
- Platform fees (Etsy listing fees, Fiverr commissions, Gumroad's percentage cut): fully deductible as business expenses.
- Training and courses: potentially deductible if directly related to your current income-producing activity, for example a prompt engineering course or a video editing workflow course. It needs to relate to your current activity, not getting into a new field entirely.

Straightforward threshold: if your AI side hustle's GST turnover reaches $75,000 in any 12-month period, you must register for GST. Most people starting an AI side hustle won't get close to this figure in the early stages, but it's worth monitoring, especially if digital product sales or freelance income grows quickly.
A note on overseas customers: digital products sold to overseas business customers are generally GST-free exports, but selling B2C through platforms can get more complex, particularly around the platform's own GST obligations, check with a tax agent if you're selling significant volume internationally.

The ATO doesn't care what software you used to produce your work, but it does care that you can substantiate your income and deductions if asked. Keep:
- Income records: invoices issued, platform payment summaries from Etsy, Fiverr or Gumroad, PayPal or Stripe transaction histories, and bank statements showing deposits
- Expense receipts: subscription confirmation emails and receipts for every AI tool, platform fee statements, course purchase receipts, and device purchase receipts
- Apportionment notes: if splitting personal and business use on any expense, keep a brief written record of how you calculated the split and why
Keep all records for at least five years from the date you lodge the relevant tax return, an ATO requirement, not a suggestion.
One more thing: using AI to help with bookkeeping or draft expense summaries is completely fine, plenty of people use tools like ChatGPT to organise records or draft invoices, but you remain responsible for the accuracy of everything you lodge. The ATO holds you accountable, not the AI tool.
